1. Acceptance of Terms
By accessing or using AidGens ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Description of Service
AidGens provides AI-powered messaging automation tools for businesses, enabling WhatsApp and multi-channel communication workflows. The Service is provided on a subscription basis.
3. Eligibility
You must be at least 18 years old and legally able to enter into binding contracts in your jurisdiction. By using the Service, you represent that you meet these requirements.
4. Account Registration
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized access. You are responsible for all activity that occurs under your account.
5. Acceptable Use
You agree not to:
- Use the Service to send unsolicited messages (spam)
- Violate any applicable law, including Morocco's Law 09-08 on personal data protection and the EU General Data Protection Regulation (GDPR) where applicable
- Reverse-engineer, decompile, or disassemble any component of the Service
- Use the Service to harass, threaten, or harm any person
6. Intellectual Property
All content, trademarks, and software comprising the Service are owned by or licensed to Hykops. You receive a limited, non-exclusive, non-transferable license to use the Service solely as described in these Terms.
7. User Content
You retain ownership of content you submit. By submitting content, you grant Hykops a limited license to process it solely to provide the Service.
8. Payment and Billing
Subscription fees are charged in advance. All fees are non-refundable except where required by law. Hykops reserves the right to modify pricing with 30 days' notice.
9. Termination
Either party may terminate this agreement. Upon termination, your right to access the Service ceases. We may suspend accounts that violate these Terms immediately and without notice.
10. Limitation of Liability
To the extent permitted by applicable law, Hykops shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service.
11. Governing Law
These Terms are governed by the laws of Morocco. Disputes shall be resolved in the courts of Casablanca, Morocco, without prejudice to mandatory consumer protection provisions under applicable law.
12. Changes to Terms
We may update these Terms. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
